Please read these Terms of Service carefully before using the Phone-In mobile application or website. By downloading, installing, or using Phone-In, you agree to be bound by these Terms. If you do not agree, do not use the application.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Phone-In ("Company", "we", "our", or "us"), governing your use of the Phone-In mobile application, website at phone-in.app, and related services (collectively, the "Service").

By accessing or using the Service, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Phone-In is an all-in-one mobile application that provides the following features:

  • Telephony and call management
  • SMS and in-app messaging
  • Contact management with smart address book
  • Calendar and scheduling with reminders
  • Camera, gallery, and media management
  • Secure file manager
  • Advanced security features (biometric lock, camouflage mode, PIN)
  • Cloud backup and data synchronization
  • Offline communication capabilities
  • Device-to-device data transfer

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice, though we will make reasonable efforts to communicate significant changes.

3. User Accounts

Certain features of the Service require account registration. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account credentials
  • Promptly notify us of any unauthorized access or breach of security
  • Accept responsibility for all activity conducted under your account
  • Not share your account credentials with any third party

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.

4. License and Permitted Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Phone-In application on devices you own or control, solely for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works of the application
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Sublicense, sell, resell, or commercially exploit the Service
  • Circumvent any technical measures designed to protect the Service
  • Use automated scripts, bots, or crawlers to access the Service
  • Remove or alter any proprietary notices or labels

5. User Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of data you store in Phone-In. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service. We will not sell your personal data to third parties.

Data stored locally on your device is encrypted. Cloud backup data is encrypted in transit and at rest using industry-standard AES-256 encryption. You are responsible for maintaining the security of your device and account credentials.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation
  • Harass, abuse, threaten, or intimidate any person
  • Transmit spam, malware, viruses, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or harvest user data without authorization
  • Interfere with or disrupt the integrity or performance of the Service
  • Engage in any illegal surveillance or unauthorized interception of communications
  • Use the camouflage or security features to facilitate illegal activity

7. Subscription and Payments

Phone-In offers both a free tier and a Premium subscription. By subscribing to Phone-In Premium, you agree to the following:

  • Billing: Subscription fees are billed in advance on a monthly or annual basis via the payment method you provide.
  • Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Cancellation: You may cancel your subscription at any time from your account settings or through the app store. Cancellation takes effect at the end of the current paid period.
  • Refunds: Payments are generally non-refundable except where required by applicable law. Refund requests are evaluated case by case.
  • Price changes: We reserve the right to change subscription prices with at least 30 days' advance notice.

8. Intellectual Property

The Service, including its original content, features, design, trademarks, and functionality, is and remains the exclusive property of Phone-In and its licensors. Our trademarks may not be used in connection with any product or service without prior written consent.

Any feedback, suggestions, or ideas you provide regarding the Service ("Feedback") may be used by us without restriction or compensation to you. By submitting Feedback, you assign to us all rights in that Feedback.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHONE-IN AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50 IF YOU HAVE NOT MADE ANY PAYMENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Phone-In and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include but are not limited to: violation of these Terms, conduct harmful to other users or to us, or non-payment of fees.

Upon termination, your right to use the Service immediately ceases. You may request an export of your data prior to termination. Sections of these Terms that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law.

13. Changes to Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you via the application, email, or by updating the "Last updated" date at the top of this page. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation.

If informal resolution fails, disputes shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
